Terms of Service
1. Acceptance
By accessing or using thermaforgepartners.com (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site. The Site is operated by ThermaForge Partners LLC, a Tennessee limited liability company ("ThermaForge," "we," "us," or "our").
2. The Site is informational
The Site provides information about ThermaForge engagements and the platform stack we deploy inside engagements. Nothing on the Site constitutes a binding offer to enter an engagement, an investment recommendation, financial advice, legal advice, tax advice, or a guarantee of any business outcome. Engagement terms are set in a separate Master Services Agreement and Statement of Work executed by both parties.
3. Eligibility
You must be at least 18 years old and have the authority to enter binding agreements on behalf of yourself or your business to use forms or initiate inquiries through the Site.
4. Acceptable use
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Site, our systems, or our service providers' systems; (c) interfere with or disrupt the Site's operation; (d) use automated tools to scrape, harvest, or extract data from the Site without our written permission; (e) submit false, misleading, or impersonating information through any form on the Site.
5. Intellectual property
All content on the Site — including text, graphics, logos, the THERMAFORGE wordmark, the ThermaForge monogram, photographs, and the underlying code — is owned by ThermaForge Partners LLC, Carson Systems LLC, or their respective licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without our prior written consent.
6. Third-party links and platform stack
The Site links to third-party properties including Routebook (runroutebook.com), Frontline AI (frontline.carson.systems), and Carson Systems (carson.systems). Those properties are operated by Carson Systems LLC and have their own terms and privacy practices. We are not responsible for the content, accuracy, or practices of any third-party site.
7. No warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THERMAFORGE PARTNERS LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless ThermaForge Partners LLC and its officers, members, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any third-party right.
10. Governing law and venue
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Rutherford County, Tennessee, and you consent to personal jurisdiction and venue there.
11. Changes
We may update these Terms at any time by posting a revised version on the Site. Changes are effective when posted. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
